  • Virtual phone numbers
  • Multi-level IVR systems
  • Inbound and outbound call management
  • Call routing and forwarding
  • Call recording
  • Call analytics and reporting
  • AI voice bot and automation tools
  • Auto dialer and outbound campaigns
  • Bulk SMS services
  • WhatsApp Business API integration
  • CRM integrations
  • API access and webhooks
  • Lead and agent management tools

We may modify, improve, suspend, or discontinue any part of our services at any time, with or without prior notice.

3. Account Registration and Security

To access certain Phonotel services, you may be required to create an account or provide business information.

You agree to:

  • Provide accurate, complete, and updated information
  • Keep your login credentials confidential
  • Restrict unauthorized access to your account
  • Notify us immediately of any unauthorized use or security breach
  • Take responsibility for all activities carried out under your account

Phonotel will not be responsible for any loss caused by your failure to maintain account security.

4. Service Usage

You agree to use Phonotel's services only for lawful, ethical, and authorized business purposes.

You must not use our services to:

  • Send spam, phishing, fraudulent, misleading, or unsolicited communication
  • Violate telecom, data protection, privacy, or communication laws
  • Harass, threaten, abuse, or mislead any person
  • Transmit harmful, illegal, offensive, or unauthorized content
  • Interfere with or disrupt Phonotel's systems, servers, or networks
  • Attempt unauthorized access, hacking, reverse engineering, or misuse of APIs
  • Use the services for illegal marketing, scam calls, impersonation, or fraudulent campaigns

We reserve the right to suspend or terminate services if misuse is detected.

5. Compliance Responsibility

You are responsible for ensuring that your use of Phonotel complies with all applicable laws, telecom regulations, privacy rules, DND/NDNC guidelines, consent requirements, and communication policies.

If you use call recording, IVR, SMS, WhatsApp, voice bot, or outbound campaign features, you are responsible for obtaining all required permissions, notices, and consents from your customers, callers, users, agents, or recipients.

Phonotel provides the technology platform, but the customer is responsible for lawful and compliant use of the platform.

6. Payments and Billing

All payments are subject to the pricing, billing cycle, plan details, and commercial terms communicated on our website, invoice, proposal, or agreement.

Unless otherwise agreed in writing:

  • Payments must be made before service activation
  • Subscription fees, setup fees, usage charges, and add-on charges may apply
  • Fees are non-refundable once services are activated or consumed
  • Delayed or failed payments may result in service suspension
  • Taxes, government charges, gateway fees, or telecom charges may be applicable
  • Pricing may change based on usage, plan upgrades, third-party costs, or business requirements

Phonotel reserves the right to suspend or terminate services in case of non-payment, payment dispute, misuse, or violation of these Terms.

7. Service Availability

We aim to provide reliable and stable services. However, we do not guarantee uninterrupted, error-free, or always-available service.

Service availability may be affected by:

  • Telecom operator issues
  • Internet or network failures
  • Third-party vendor downtime
  • Maintenance or upgrades
  • Force majeure events
  • Regulatory restrictions
  • Customer-side configuration errors

Phonotel will not be liable for service interruptions caused by third-party providers, telecom operators, internet failures, or circumstances beyond our reasonable control.

8. Third-Party Services and Integrations

Phonotel may integrate with third-party platforms such as:

  • CRM systems
  • WhatsApp Business API providers
  • SMS gateways
  • Payment gateways
  • Cloud hosting providers
  • Analytics tools
  • Automation platforms
  • Webhooks and APIs

Your use of third-party services may be subject to their own terms, policies, pricing, and limitations.

Phonotel is not responsible for failures, delays, policy changes, pricing changes, data issues, or service interruptions caused by third-party platforms.

9. Intellectual Property

All content, software, website design, branding, logos, graphics, documentation, code, platform features, and materials related to Phonotel are owned by Phonotel or its licensors.

You may not copy, reproduce, modify, distribute, reverse engineer, resell, or commercially exploit any part of our website, software, or services without prior written permission.

Using Phonotel's services does not give you ownership of our intellectual property.

10. Data Privacy

Your use of Phonotel is also governed by our Privacy Policy.

By using our website or services, you consent to the collection, use, storage, and processing of information as described in our Privacy Policy.

You are responsible for ensuring that any customer, caller, lead, employee, or third-party data uploaded or processed through Phonotel has been collected lawfully and with proper consent.

11. Customer Data and Communication Content

You retain ownership of the business data, customer data, call data, messages, recordings, and content that you submit or process through Phonotel.

You grant Phonotel permission to process such data only as required to:

  • Provide the services
  • Maintain platform functionality
  • Deliver reports and analytics
  • Troubleshoot issues
  • Improve reliability and security
  • Comply with legal obligations

You are responsible for the accuracy, legality, and consent status of all data processed through your account.

12. Suspension and Termination

Phonotel may suspend or terminate your access to services if:

  • You violate these Terms
  • Payment is overdue
  • Your usage creates security, legal, or operational risk
  • You misuse the platform
  • Required by law, telecom operator, regulator, or government authority
  • Your activity harms Phonotel, its systems, users, partners, or reputation

Upon termination, access to services may be disabled, and data may be retained or deleted as per our Privacy Policy, legal obligations, and internal retention practices.

13. Limitation of Liability

To the maximum extent permitted by law, Phonotel will not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, business, goodwill, or data
  • Service downtime or communication delays
  • Third-party platform or telecom operator failures
  • Unauthorized access caused by customer-side negligence
  • Misuse of services by the customer or its users
  • Legal claims arising from unlawful customer communication

In any case, Phonotel's total liability shall not exceed the amount paid by you for the services during the last three months before the claim arose.

14. Indemnity

You agree to indemnify and hold Phonotel, its team, partners, vendors, and affiliates harmless from any claims, losses, damages, penalties, liabilities, costs, or expenses arising from:

  • Your misuse of the services
  • Violation of these Terms
  • Violation of applicable laws or telecom regulations
  • Unauthorized or unlawful communication
  • Breach of privacy, consent, or data protection obligations
  • Content, data, or campaigns run through your account

15. Third-Party Links

Our website may contain links to third-party websites or services.

Phonotel is not responsible for the content, privacy practices, terms, accuracy, or reliability of third-party websites. Accessing such links is at your own risk.

16. Changes to Terms

We may update these Terms from time to time.

Updated Terms will be posted on this page with a revised effective date. Continued use of Phonotel's website or services after changes means you accept the updated Terms.

17. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising from or related to these Terms, website, or services shall be subject to the jurisdiction of the courts located in Delhi, India.
